Evan Foxx graduated from the University of Rhode Island in 2006 with distinction, being awarded the Ter Horst Award for Political Communication. In 2010, he graduated from St. John’s University School of Law. While in law school, Mr. Foxx was a member of the Environmental Law Society, served as an environmental law research assistant for Professor Julie E. Steiner, and was a C.A.L.I. Award recipient for earning the highest G.P.A. in Legal Writing II.

Prior to joining Cooley, Cooley & Foxx, Mr. Foxx worked for a mid-sized firm in New York City, concentrating on civil litigation, defending medical malpractice, products liability, toxic tort, and general liability claims. Mr. Foxx is admitted to practice before all state courts in Vermont and New York, as well as the U.S. District Courts for the Southern and Eastern Districts of New York and District of Vermont. He represents clients in all areas of litigation, including discovery, trials, appeals and mediation.  His practice focuses on civil litigation with a particular concentration on business and construction disputes and professional liability. Mr. Foxx’s clients include health care facilities, design professionals, lawyers, real estate professionals, home owners, and contractors. In addition to his litigation practice, Mr. Foxx represents clients in business transactions, employment matters, real estate transactions, administrative proceedings, and alternative dispute resolution.

While not in the office, Mr. Foxx enjoys hiking, skiing, and biking with his wife and son.

Recent Notable Experience

  • Obtained summary judgment affirmed on appeal in a legal malpractice claim involving an environmental enforcement action.   • Obtained summary judgment based on economic loss rule for engineering firm. Miller v. Cross Consulting Engineers, No. 966-10-17 Cncv (2021)

  • Obtained summary judgment affirmed on appeal concerning accrual of the statute of limitations in a claim against an architectural firm. Abajian v. TruexCullins, Inc., 2017 VT 74, 205 Vt. 331.  

  • Obtained dismissal of medical malpractice claims for failing to comply with statutory pleading requirements. Tigue v. Bennington Health & Rehab Ctr., No. 33-2-17 Bncv (2017)
